En aplicación de los Artículos 7 y 28 de los Estatutos de la FIA, se instituye un órgano disciplinario denominado Comité Disciplinario Antidopaje
de la FIA (en adelante, el  «CDA» ), investido como autoridad disciplinaria de primera instancia para deportistas y demás personas contempladas
en las disposiciones del Reglamento Antidopaje de la FIA (en adelante,
el  «Reglamento» ) sobre las que recaigan sospechas de que han contravenido las normas antidopaje. Para resolver los asuntos sometidos a su
consideración, el CDA aplicará las disposiciones del Reglamento y las
normas de procedimiento detalladas a continuación (en adelante, las
«Normas de Procedimiento»).
Las normas de procedimiento son redactadas en francés y en inglés.
En caso de diferencias de interpretación, prevalece el texto en francés.

In accordance with Articles 7 and 28 of the FIA Statutes, a disciplinary body
known as the FIA Anti-Doping Disciplinary Committee (hereinafter “ADC”)
has been set up, which is invested with disciplinary power in the first instance over Athletes and other Persons subject to the provisions of the
FIA Anti-Doping Regulations (hereinafter “the Regulations”), who are suspected of having infringed the Regulations. In order to decide the cases
submitted to it, the ADC shall apply the provisions of the Regulations and
the rules of procedure below (hereinafter “Rules of Procedure”).
The Rules of Procedure are drafted in French and in English.
In case of any difference of interpretation, the French text shall take
precedence.

ElCDA está compuesto por doce miembros, con un Presidente, elegidos
por la Asamblea General a propuesta del Consejo Mundial del Deporte
del Automóvil.
Los miembros del CDA son elegidos para mandatos de 3 años, renovables por tercios cada año.
En 2011, el Consejo Mundial del Deporte del Automóvil propondrá a
doce candidatos para miembros del CDA, de los cuales un tercio será
elegido para un mandato de un año (únicamente para 2012), otro tercio para 2 años (2012 y 2013) y otro tercio para 3 años (2012-2014). En
los años siguientes (a partir de 2012), el Consejo Mundial del Deporte
del Automóvil propondrá los candidatos que serán elegidos para mandatos de 3 años.
Los miembros deben probar que cuentan con experiencia en materia jurídica y/o médica.
En caso de puesto vacante de un miembro del CDA por cualquier motivo,
el Consejo Mundial del Deporte del Automóvil puede proponer a la
Asamblea General su reemplazo por la duración del mandato que quede
por cubrir.

The ADC comprises twelve Members, including a Chairman, elected by
the General Assembly upon proposal of the World Motor Sport Council.

Para cada caso, el Presidente del CDA nombrará, de entre los miembros
del CDA, un cuerpo colegiado formado por tres miembros como mínimo,
uno de los cuales será designado Presidente de la sala formada en el
CDA para dicho caso (en adelante, el «Presidente del caso»).
El Presidente del caso estará encargado de llevar adelante el proceso,
de verificar que se proceda de manera regular, de garantizar el respeto
de los derechos de las Partes, de asegurar la celebración y el orden de la
audiencia, y la redacción de la resolución.
Toda deliberación de la sala formada del CDA solo tendrá validez si al
menos el Presidente del caso y dos de sus miembros están presentes.
Los miembros del CDA no pueden tomar parte en las deliberaciones si
tienen intereses en el caso.
Los miembros del CDA están obligados a guardar secreto profesional de
los hechos, actos e informaciones de los que puedan tener conocimiento
en el ejercicio de sus funciones. Cualquier infracción a la presente disposición supone la exclusión inmediata del miembro pronunciada por el
Consejo Mundial del Deporte del Automóvil.
Excepto por la posible presencia de representantes de la AMA y de la
ADN que ha expedido la licencia al deportista o a la otra persona, las
deliberaciones ante la sala formada del CDA no son públicas, salvo petición en contrario formulada antes de la apertura de la audiencia por el
deportista, la otra persona o sus defensores.
B.4
El Responsable de la Comisión Médica de la FIA tendrá a su cargo
la instrucción de cada caso (en adelante, el  «Responsable de la
Instrucción» ). Este deberá obtener de los oficiales competentes el acta
de control, preparada por el Agente de Control de Dopaje, en la que se
refieran las condiciones en que se efectuaron las tomas de muestras y
los exámenes, el acta con el resultado de los análisis elaborada de conformidad con el Reglamento, y todos los elementos que sean de utilidad
para la instrucción de la causa.
El Responsable de la Instrucción está obligado a guardar secreto profesional de los hechos, actos e informaciones de los que pueda tener
conocimiento en el ejercicio de sus funciones.

The members of the ADC are elected for a term of 3 years, and one third
of the composition of the ADC is renewable each year.
In 2011, the World Motor Sport Council will propose twelve candidates
to be members of the ADC; one third will be elected for 1 year (2012
only), one third for 2 years (2012 and 2013) and one third for 3 years
(2012-2014). In subsequent years (2012 onwards), the World Motor Sport
Council will propose candidates for election for 3-year terms.
The members must have proven expertise in legal and/or medical matters.
If a seat on the ADC becomes vacant for whatever reason, the World
Motor Sport Council may propose to the General Assembly the replacement of that member for the remainder of his term of office.

For each case, the President of the ADC appoints from among the members of the ADC a judging panel, made up of a minimum of three members, one of whom he appoints as President of the ADC’s judging panel
for that case (“the President of the Hearing”).
The President of the Hearing is responsible for conducting the proceedings, verifying the regularity of the proceedings, ensuring that the rights
of the parties are respected, keeping order during the hearing and arranging for the drafting of the decision.
The deliberations of the ADC’s judging panel are valid only if at least the
President of the Hearing and two of its Members are present.
The Members of the ADC shall not participate in the deliberations if they
have an interest in the case.
The Members of the ADC shall be obliged to maintain professional
secrecy with regard to any facts, acts and information of which they have
become aware through the execution of their duties. Any violation of this
provision shall result in the immediate exclusion of the Member by the
World Motor Sport Council.
Except for the possible presence of representatives of WADA and the
ASN that issued the licence to the Athlete or other Person, the arguments before the ADC’s judging panel shall not be made in public, unless
a request to the contrary has been filed by the Athlete or other Person or
by his Defence Counsel before the opening of the session.

B.4
The representative of the FIA Medical Commission shall be tasked with
conducting the inquiry for each case (hereinafter “Investigator”). He
must obtain from the competent officials, the written report of the doping
test, as completed by the Doping Control Officer, that states the conditions under which the Samples were taken and the tests were carried
out; he must also obtain the written report of the result of the analysis
that was established in conformity with the Regulations, as well as all
other elements pertinent to the investigation of the case.
The Investigator shall be bound by an obligation of confidentiality with
regard to any facts, acts and information of which he becomes aware
