la Instrucción no podrá cerrar por sí mismo el caso, aun si el deportista
o la otra persona alega justificativos terapéuticos. En cualquier circunstancia, la competencia corresponde al CDA. El CDA tiene la obligación
de tomar una resolución por cada caso que se le presente, incluso si se
cierra el caso.

Where a violation of the Regulations is confirmed, the Investigator may
not dismiss a case himself, even if therapeutic justifications are pleaded by the Athlete or other Person. In all circumstances, the ADC shall
remain the competent body. It is the duty of the ADC to reach a decision in each case submitted, including the possible dismissal of the
case.

El Responsable de la Instrucción también informará al deportista o a la
otra persona y, llegado el caso, a sus representantes legales, que se ha
iniciado un procedimiento disciplinario en su contra, mediante el envío
de un documento en el que se enuncien los cargos presentados, por
carta certificada con acuse de recibo o por cualquier otro medio, como
la entrega en propia mano contra recibo firmado, que permita probar su
recepción por parte del destinatario.
El Responsable de la Instrucción también informará a la ADN que ha
expedido la licencia al deportista o a la otra persona, a la organización
nacional antidopaje correspondiente al deportista o a la otra persona, y
a la AMA.

The Investigator informs the Athlete or other Person and, as the case
may be, his legal representatives, that disciplinary proceedings have
been instigated against him by sending him a document specifying the
complaints filed, in the form of a registered letter with a request for proof
of receipt, or by any other means, such as delivery by hand against a chit
providing proof of its receipt by the addressee.

The document specifying the complaints that have been filed must,
should such a case arise, be accompanied by the result of the analysis
and the notification to the Athlete of his right to request, by registered letter with a request for proof of receipt, that a second analysis be carried
out in accordance with the provisions of the Regulations and at his own
expense. This document shall be sent, by registered letter with a request
for proof of receipt, within four days of the receipt of the registered letter
provided for in the above article.
As soon as this request has been received, the Investigator shall advise
the anti-doping laboratory accordingly.

Al documento en el que se enuncian los cargos formulados deberá adjuntarse, si correspondiera, el resultado del análisis y la mención de que el
deportista tiene la posibilidad de solicitar, mediante carta certificada con
acuse de recibo enviada dentro de un plazo de cuatro días a partir de la
recepción de la carta certificada prevista en el artículo anterior, que se
realice, a su cargo, un segundo análisis en las condiciones previstas en
el Reglamento.
En cuanto reciba esta solicitud, el Responsable de la Instrucción deberá
requerir la intervención del laboratorio antidopaje.

Al expirar el plazo de cuatro días fijado por el artículo anterior o al recibirse los resultados del segundo análisis que demuestre o no el uso de
una sustancia prohibida o de un método prohibido, y a la vista de los elementos del expediente, el Responsable de la Instrucción elaborará, en un
plazo máximo de dos semanas, un informe que será enviado a los miembros de la sala formada del CDA.

El deportista o la otra persona, acompañado(a), llegado el caso, de
sus representantes legales, será citado(a) por el Presidente del caso,
mediante carta certificada con acuse de recibo o por carta entregada
en mano y contra recibo, al menos quince días antes de la fecha de la
audiencia de la sala formada del CDA.
El deportista o la otra persona puede recurrir a la asistencia de uno o
varios defensores de su elección. En cuanto reciba la citación, deberá
informar si necesita contar con un intérprete durante la audiencia de la
sala formada del CDA y, llegado el caso, el idioma requerido para la
interpretación.
Mediante petición por escrito dirigida al Responsable de la Instrucción, el
deportista o su defensor pueden exigir copias del expediente del análisis
para las muestras A y B, que incluya los documentos estipulados en el
Estándar Internacional para Laboratorios.
El deportista o la otra persona puede solicitar que sean escuchadas las
personas de su elección, cuyos nombres comunicará al Presidente del
caso al menos ocho días antes de la reunión de la sala formada del CDA.
El Presidente del caso puede rechazar las peticiones de declaraciones
de carácter abusivo. Dicho rechazo será informado al deportista o a la
otra persona dentro de las cuarenta y ocho horas posteriores a la recepción de su petición.

Athlete or other Person, the National Anti-Doping Organisation of the
Athlete or other Person and WADA.

As soon as the four-day deadline established in the above article has
expired, or upon receipt of the result of the second analysis confirming
or rejecting the use of a prohibited substance or a prohibited method,
based on the contents of the dossier, the Investigator shall compile a
report that he shall send to the members of the ADC’s judging panel
within a deadline of two weeks.

The Athlete or other Person, accompanied or not, as the case may be,
by his legal representatives, shall be summoned by the President of the
Hearing by means of a registered letter with a request for proof of receipt
or by a letter delivered by hand against a receipt, at least fifteen days prior
to the date of the hearing before the ADC’s judging panel.
The Athlete or other Person may be assisted by one or more Defence
Counsels of his own choice. Upon receipt of the summons, he shall specify if he requires the services of an interpreter for the hearing before
the ADC’s judging panel and, should this be the case, the language of
interpretation.
By addressing a written request to the Investigator, the Athlete or his
Defence Counsel may request copies of the A and B Sample laboratory
documentation package which includes information as required by the
International Standard for Laboratories.
The Athlete or other Person may request that certain persons of his
choice be called to testify and he shall furnish the President of the Hearing
with a list of such names at least eight days before the meeting of the
ADC’s judging panel. The President of the Hearing may refuse any such
requests that are of an improper nature. The Athlete or other Person
shall be notified of any such refusal within forty-eight hours of the receipt
of his request.
