La sala formada del CDA sesiona a puerta cerrada, excepto por la presencia del deportista o de la otra persona, sus defensores, de las personas
que prestan declaración en la audiencia, de los eventuales representantes de la AMA y de la ADN que ha expedido la licencia al deportista o a
la otra persona y del Responsable de la Instrucción. La sala formada del
CDA se pronuncia mediante una decisión motivada.
Las decisiones se toman por mayoría simple de los miembros de la sala
formada del CDA, el Presidente del caso tiene voto dirimente si hay
empate en la votación.
Las decisiones se toman, en principio, durante las reuniones, pero, en
caso de urgencia o de necesidad, la deliberación y la votación pueden
realizarse por correo postal, por fax o por correo electrónico, y las reuniones pueden celebrarse por videoconferencia o por conferencia telefónica.
La decisión es firmada por el Presidente del caso.
Inmediatamente, es notificada al deportista o a la otra persona por carta
certificada con acuse de recibo o por carta entregada en mano y contra
recibo al deportista o a la otra persona. La notificación menciona los procedimientos y plazos para la apelación.
Luego, la decisión también será notificada, por carta certificada con
acuse de recibo, a la ADN que ha expedido la licencia al deportista o a la
otra persona, a su organización antidopaje y a la AMA.

En aplicación del Artículo 29 de los Estatutos de la FIA, cualquier decisión adoptada por la sala formada del CDA puede ser recurrida, exclusivamente ante el Tribunal de Arbitraje Deportivo (Suiza) (en adelante, el
«TAD»), por el deportista o la otra persona a el/la cual la ADN que le ha
expedido la licencia no podrá negarle su apoyo, o bien por la FIA. El procedimiento aplicable ante el TAD es el previsto en el Código de Arbitraje
Deportivo.
El plazo para interponer la apelación es de veintiún días a partir de la
recepción de la decisión que se desea apelar.
Las partes que interponen apelación ante el TAD deben actuar con toda
la diligencia necesaria, de conformidad con las disposiciones aplicables
ante esa instancia.

The ADC’s judging panel shall conduct its deliberations in camera, without
the presence of the Athlete or other Person, his Defence Counsel, any
people having been called to testify, possible representatives of WADA
and the ASN that issued the licence to the Athlete or other Person, or
the Investigator. The ADC’s judging panel’s decision shall be reasoned.
The decision shall be taken by the simple majority of the members of the
ADC’s judging panel. The President of the Hearing will have a casting
vote.
Decisions are in principle taken during meetings, but deliberation and
voting by correspondence, fax, e-mail, and the holding of meetings via
videoconference or conference call are permissible in case of urgency
or necessity.
The decision shall be signed by the President of the Hearing.
The decision is immediately notified to the Athlete or other Person by
registered letter, with a request for proof of receipt, or in a letter delivered
by hand to the Athlete or other Person against a receipt. The notification
shall state the procedure and the deadline for an appeal.
The decision shall also then be notified by registered letter, with a request
for proof of receipt, to the ASN that issued the licence to the Athlete or
other Person, his National Anti-Doping Organisation and WADA.

In accordance with Article 29 of the FIA Statutes, each decision taken
by the ADC’s judging panel can be the subject of an appeal exclusively
brought before the Court of Arbitration for Sport, Switzerland (hereinafter
“CAS”), either by the Athlete or other Person, whom the ASN that issued
his licence is obliged to help, or by the FIA. The procedure that applies
before the CAS is the Code of sports-related arbitration.
The time limit for appeal is twenty-one days after receipt of the decision
concerning the appeal.
All parties filing an appeal with the CAS shall act with due diligence in
accordance with the provisions applicable before such court.

as follows:
I confirm that I shall comply with and be bound by all of the provisions of
the FIA Anti-Doping Regulations, including but not limited to, all amendments to the Anti-Doping Regulations and all International Standards as
issued by the World Anti-Doping Agency and permanently published on
its website.
I acknowledge that the ASNs, the FIA and the National Anti-Doping
Organisations have jurisdiction to impose sanctions as provided in the
FIA Anti-Doping Regulations.
